HeyBoss AI Terms of Service

These terms constitute a legal agreement between you and Hee Labs, Inc. ("Hee Labs," "we," or "us"). Your use of HeyBoss.ai (the "Site") and the services made available on the Site ("Services") is subject to these Terms of Service. By using the Site and any of our Services, you:

  • Acknowledge that you have read and understood these Terms.
  • Agree to be bound by these Terms.
  • Agree to our Privacy Policy.
  • Commit to comply with all applicable laws and regulations.

Age Requirements and Eligibility

You must be at least 13 years of age to use our Services. If you are between 13 and 18 years old, you may only use our Services with the consent and supervision of a parent or legal guardian. Users under 13 are prohibited from using our Services in compliance with the Children's Online Privacy Protection Act (COPPA).

License to Use Our Services

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable license to use our Services. This license includes the right to use our Services for both personal and commercial purposes, subject to your subscription plan and these Terms.

  • The "Hee Labs" name and brand.
  • The "HeyBoss AI" brand and trademark.
  • The "HeyBoss.ai" domain name and all related domains and variants.
  • All Hee Labs and HeyBoss AI logos, designs, and visual elements.
  • Marketing materials and website content.

Platform Elements

  • The Site architecture and design.
  • All platform features and functionalities.
  • Proprietary algorithms and AI systems.
  • Documentation and supporting materials.

Your Rights

Hee Labs makes no claim to ownership of:

  • All code, applications, or solutions you create using our Services.
  • Custom implementations and modifications made by you.
  • Your business logic and application structure.

You may freely:

  • Use generated content commercially.
  • Modify and adapt generated content.
  • Distribute, sell, or open-source applications built using our platform.

User-Generated Content and Acceptable Use

Content Responsibility

You are solely responsible for all content, websites, and applications you create or generate using our Services. This includes ensuring that your content:

  • Complies with all applicable laws and regulations
  • Does not infringe on any third-party intellectual property rights
  • Does not contain illegal, harmful, or offensive material
  • Does not facilitate fraud, scams, or deceptive practices

Prohibited Content and Activities

You may not use our Services to create or distribute:

  • Content that promotes violence, hatred, or discrimination
  • Pornographic, sexually explicit, or adult content
  • Content that facilitates illegal activities, including but not limited to fraud, scams, or phishing
  • Content that infringes on copyrights, trademarks, or other intellectual property rights
  • Malicious code, viruses, or security exploits
  • Spam, unsolicited communications, or content designed to manipulate search rankings
  • Content that violates privacy rights or applicable data protection laws
  • Websites that clone or impersonate existing legitimate websites or services
  • Content related to cryptocurrency mining, illegal gambling, or controlled substances

Automated Abuse Detection

We employ automated systems to detect potential violations of these Terms. While we make reasonable efforts to prevent abuse, these systems may occasionally produce false positives or fail to detect all violations.

Enforcement and Appeals

If we determine that your content violates these Terms, we may:

  • Remove or disable access to the violating content
  • Suspend or terminate your account
  • Report violations to appropriate authorities when required by law

Public Projects and Community Templates

Free User Public Projects

Free users do not have access to private project functionality. When you publish a project as a free user:

  • Your project becomes part of HeyBoss AI's public community template library
  • You grant HeyBoss AI a perpetual, royalty-free license to use, modify, distribute, and display your published project
  • HeyBoss AI may use your published project for research, development, and improvement of our Services
  • You cannot later claim exclusive ownership or request removal based on intellectual property rights
  • We will provide clear disclosure before you publish any project about these terms

For users with active paid subscriptions:

  • You retain full ownership and control over your private projects
  • We will not use your private projects without your explicit written consent
  • Your projects remain private and are not added to community templates

AI-Generated Content Disclaimer

Content Accuracy and Quality

Our AI systems generate website code, designs, and content based on your inputs. However:

  • AI-generated content may contain errors, bugs, or security vulnerabilities
  • Generated code may not follow current best practices or web standards
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any specific purpose
  • You are responsible for testing, validating, and ensuring the quality of all generated content before use

Third-Party Integrations

Websites created using our platform may integrate with third-party services (payment processors, maps, social media APIs, etc.). We are not responsible for:

  • The availability, functionality, or policies of third-party services
  • Changes in third-party service fees, terms, or functionality
  • Data security or privacy practices of integrated third-party services
  • Any issues arising from third-party service integrations

Data Usage, Privacy, and Compliance

Our Data Practices

Your use of our platform contributes to its continuous improvement. While our Privacy Policy provides detailed information about data collection and processing, we use your data to:

  • Enhance platform performance and reliability
  • Identify areas for improvement and develop new features
  • Provide effective technical support
  • Comply with legal obligations

For enterprise customers, we offer enhanced data protection and control, including custom data handling agreements.

User Website Data Compliance

Websites you create may collect visitor data. You are solely responsible for:

  • Compliance with applicable privacy laws (GDPR, CCPA, etc.)
  • Implementing appropriate privacy notices and cookie policies
  • Obtaining necessary user consents for data collection
  • Secure handling of any personal data collected through your websites
  • Cross-border data transfer compliance

If you believe content on our platform infringes your intellectual property rights, please contact us immediately at contact@heyboss.ai with:

  • A detailed description of the copyrighted work you claim has been infringed
  • The URL or location of the allegedly infringing content
  • Your contact information and a statement of good faith belief that the use is not authorized
  • A statement that the information provided is accurate and that you are authorized to act on behalf of the owner

We will investigate all legitimate complaints promptly and take appropriate action.

Repeat Infringers

We maintain a policy of terminating accounts of users who are repeat copyright infringers.

Service Availability and Resource Management

Service Limitations

Our Services are provided "as is" and "as available." We do not guarantee:

  • 100% uptime or uninterrupted service availability
  • Specific performance levels or response times
  • Compatibility with all browsers or devices
  • Freedom from bugs, errors, or security vulnerabilities

Fair Use and Resource Limits

To ensure fair access for all users, we implement reasonable usage limits on:

  • Compute resources and processing time
  • Storage space and bandwidth
  • Number of projects and requests per time period
  • API calls and automated interactions

Excessive use that impacts platform performance or other users may result in temporary restrictions or account suspension.

Project Hosting and Maintenance

Active Project Hosting

We provide hosting services for active projects based on your subscription level. For optimal platform performance:

  • Free user projects may have limited bandwidth, storage, and availability
  • Paid user projects receive enhanced hosting resources and support

Inactive Project Cleanup

To maintain platform performance and manage costs:

  • Projects that remain inactive for extended periods may be archived or removed
  • We will provide at least 30 days advance notice via email before removing any projects
  • Free user projects and expired paid subscriptions are subject to more frequent cleanup
  • Users can contact us to restore recently archived projects

Data Export

Before any project removal, we will provide reasonable opportunity for you to export your project data and code.

Account Management and Termination

Account Security

You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Promptly notifying us of any unauthorized access

Account Termination

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent or abusive behavior
  • Fail to pay applicable fees (for paid accounts)
  • Remain inactive for extended periods

Export Controls and Sanctions

Our Services may be subject to U.S. export control laws and regulations. You agree not to use our Services in any manner that violates applicable export control laws.

Geographic Restrictions

Certain features or services may not be available in all countries or regions due to legal restrictions or business considerations.

Plans, Pricing, and Payment

We offer both free and paid subscription plans. Details are available at heyboss.ai/pricing.

Subscription Terms

  • Subscriptions are billed monthly and automatically renew unless canceled
  • No refunds are provided for partial billing periods
  • Access remains active until the end of the current billing period after cancellation
  • Prices are subject to change with reasonable advance notice

Free Plan Limitations

Free plans include limitations on storage, bandwidth, features, and project privacy. Upgrading to a paid plan removes these restrictions.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HEE LABS SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
  • DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR INABILITY TO ACCESS THE SERVICES
  • DAMAGES CAUSED BY THIRD-PARTY INTEGRATIONS OR SERVICES
  • SECURITY BREACHES OR UNAUTHORIZED ACCESS TO YOUR DATA

OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Hee Labs, its employees, officers, directors, and affiliates from any claims, liabilities, damages, or expenses (including reasonable attorney fees) arising from:

  • Your use of the Services
  • Websites, applications, or content created using our platform
  • Your violation of these Terms or applicable laws
  • Infringement of third-party rights by your content or activities
  • Any data privacy or security breaches related to your websites

Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. Material changes will be communicated through:

  • Email notification to registered users
  • Prominent notice on our website
  • In-app notifications

Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Services must be resolved exclusively in the state or federal courts located in San Francisco, California.
